Terms of Service

The terms for using the Hydrolus website.

Effective September 23, 2026

In short

These Terms cover your use of this website. Everything on the Site is general information. Performance figures are design targets and estimates, not guarantees, and nothing on the Site is an offer of products, services, or securities. Only a signed agreement binds either of us, and it takes precedence over the Site. Texas law applies.

About these terms

These terms of service (the “Terms”) govern your use of www.hydrolus.com (the “Site”), operated by Hydrolus, Inc. (“Hydrolus”, “we”, “us”). By using the Site you accept these Terms and our Privacy Policy. If you do not accept them, please do not use the Site.

The Site is meant for business users aged 18 or older. If you use it for a company or public agency, you confirm that you may accept these Terms for it.

Information only, not an offer

Everything on the Site is general information. That includes the descriptions of our technology, including Nanosprings™ and our system designs, of our solutions and deployment models, and of the resources and guides. None of it is an offer to sell products or services, or a commitment on price, performance, availability, or delivery.

Performance figures are targets, not guarantees.Figures such as water recovery rates, reductions in chemical use, and uptime are design targets or estimates based on testing, modeling, and engineering assumptions. Actual results depend on each site's water chemistry, flows, operating conditions, and project design.

A project exists only when both parties sign a written agreement. That agreement fixes the terms that bind, including any performance commitments. Industry figures and other statistics on the Site come from sources we consider reliable when we publish them. They change over time and may not be current.

No offer of securities

Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any security or other interest in Hydrolus. An investment inquiry sent through the Site is only an expression of interest. Any offer of securities will be made only through definitive offering documents, to eligible investors, and as the law allows.

Forward-looking statements

The Site includes statements about our plans, technology development, future deployments, and the markets we serve. These statements reflect our expectations when we publish them. They are not promises, and they involve risks and uncertainties that could make actual results differ materially. We do not undertake to update them.

No professional advice

Nothing on the Site is engineering, environmental, permitting, regulatory, legal, financial, or investment advice. Using the Site or contacting us does not create an advisory, fiduciary, or agency relationship. Get advice from qualified professionals before you act.

Calculators and tools

The cooling tower blowdown calculator and any similar tools on the Site give simplified estimates from the values you enter. They are for early planning discussions only and are not a substitute for engineering design or a site assessment. They run in your browser, and what you enter is not sent to us.

Inquiries

Sending the contact form or an email to us does not create a contract and does not oblige either of us to go further. We may decline any inquiry. By contacting us, you agree that we may reply by email or phone about your inquiry.

Unless we have signed a confidentiality agreement with you, please do not send confidential or proprietary information through the Site, such as detailed water quality data or facility plans. If a project discussion needs that information, ask us about a confidentiality agreement first. We handle what you send as our Privacy Policy describes.

Acceptable use

When you use the Site, do not:

  • send spam, bulk, or automated messages through the contact form, or try to get around its bot protection;
  • try to get unauthorized access to the Site or its systems, probe or test their security, or disrupt them, for example with excessive automated requests;
  • upload or send malware or other harmful code;
  • impersonate Hydrolus or anyone else, or send false or misleading information;
  • use the Site for anything unlawful or fraudulent.

We may block access from anyone who breaks these rules.

Intellectual property

The Site and its content belong to Hydrolus or its licensors and are protected by intellectual property law. That includes the text, graphics, diagrams, animations, and design, the calculators, and the Hydrolus name, logo, Nanosprings™, and our other marks.

You may view the Site and print or save pages for your own internal business use. Without our written permission, you may not copy, republish, or sell its content, or use our name or marks. That includes any use that suggests you act for Hydrolus or with its approval.

Privacy

Our Privacy Policy explains what the Site collects and how we use it. The Site sets no cookies.

Availability and changes to the Site

We may change, suspend, or remove any part of the Site at any time. We do not promise that the Site will always be available or free of errors.

Disclaimer

To the fullest extent the law allows, the Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied. That includes warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent the law allows, Hydrolus and its owners, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages. They are also not liable for lost profits, revenue, business opportunities, or data. This applies to any loss that arises from your use of the Site or your reliance on it, even if we were told such loss was possible. Our total liability for any claim about the Site is limited to one hundred U.S. dollars (US$100).

Nothing in these Terms limits liability that the law does not allow to be limited. These limits apply to the Site only. A signed project agreement sets its own terms.

Indemnity

If a third party makes a claim against Hydrolus because you broke these Terms or the law while using the Site, you agree to cover the resulting losses, costs, and reasonable legal fees.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Only the state or federal courts located in Texas may hear any dispute about the Site or these Terms, and you consent to their jurisdiction.

General

These Terms and our Privacy Policy are the whole agreement between you and Hydrolus about the Site. For any project, the signed agreement for that project takes precedence over them. If a court finds part of these Terms unenforceable, the rest stays in effect. If we do not enforce a term, we have not waived it. We may transfer these Terms to a successor. You may not transfer them without our consent.

Changes to these Terms

We may update these Terms. The effective date at the top shows when they last changed. If you keep using the Site after a change, you accept the updated Terms.
